AISV and VIEU Template Agreement

For the whole of 2007, VIEU has been negotiating with the AISV towards a "template" document for bargaining in independent schools.

VIEU's position in negotiations was to ensure that the template faithfully reflected pre-reform award provisions and that amendments should only be made to ensure that it was compliant with the Workplace Relations Act and in particular the Australian Fair Pay and Conditions Standard CAFPCS]. The template should then be used as a base on top of which school bargaining could occur.

The intersection of the AFPCS with the Teachers' Award was particularly difficult to resolve as the entitlement to a 38-hour week and 4 weeks annual leave had to be translated for teachers' work. VIEU was concerned to protect the status quo and custom and practice in independent schools - paid school holidays, with many schools having more student free days than the gazetted school dates as a historic recognition of the work performed during term time.

At the time of writing a final meeting had been held with the AISV on 5 December about some remaining issues of difference between the parties. The majority of the outstanding issues related to employer concerns about the effect of the 38-hour week provisions of the Act on payments to teachers and the wording of the parental leave provisions. It is expected that the parties will agree on final wording before the New Year and that the template will be a useful basis for bargaining in 2008.
